Mission

NMa enforces the prohibition on cartels and on the abuse of a dominant position and assesses mergers and acquisitions. In addition to NMa’s tasks under the Competition Act, the Office of Energy Regulation [Directie Toezicht Energie (DTe)] has been included within NMa as a chamber. DTe is responsible for the implementation and supervision of the Electricity Act of 1998 and the Gas Act of 2000. The specific mission of this chamber within NMa is to promote competition on the electricity and gas markets. This includes protecting customers from the abuse of power. Even where the market cannot operate without regulation (for instance due to natural monopolies), DTe ensures that market forces operate in these network sectors.
 

Activities

DTe's package of tasks includes issuing supply licences for the supply of electricity and gas to captive customers, issuing an exemption from the obligation to appoint an electricity grid manager, determining guidelines for tariffs and conditions, once every two years assessing whether the electricity grid managers and the gas network managers have met the need for transmission capacity adequately and efficiently on the basis of estimates of the need for transmission capacity submitted by the electricity grid managers and the gas network managers, supervision of compliance with the Electricity Act and the Gas Act and advising the Minister of Economic Affairs on applications for approval of the appointment of electricity grid managers and gas network managers
